DWI Laws That Apply in Miller County

Arkansas Code Annotated § 5-65-103 is the main DWI statute. A BAC of 0.08% or higher while operating a motor vehicle is a per se violation. A first DWI is a Class A misdemeanor. Penalties include up to one year in jail, a fine from $150 to $1,000, and a six-month license suspension. A second DWI within the 10-year lookback period brings seven days to one year in jail, a $400 to $3,000 fine, and a 24-month suspension.

A third DWI within 10 years carries 90 days to one year in jail, a $900 to $5,000 fine, and a 30-month suspension. A fourth or later DWI within 10 years is a felony. The penalty jumps to one to six years in prison, a $900 to $5,000 fine, and a four-year license revocation. Arkansas does not allow plea bargaining a DWI charge down to a lesser offense, so these records stay as DWI in the court system.

The implied consent law under ACA § 5-65-202 applies statewide. Refusing a chemical test triggers automatic suspension. First refusal: 180 days. Second refusal within five years: two years.
