Lonoke County Sheriff's Office

No plea deals for underage DUI. Second: $200 to $1,000 fine, one-year suspension. Third: $500 to $2,000 fine, revocation for three years or until age 21. No probation or plea bargaining allowed.

Implied consent (ACA § 5-65-202) means all drivers consent to BAC testing when lawfully stopped in Arkansas. First refusal: 180-day suspension. Second within five years: two-year suspension. Third: three-year revocation. Fourth: lifetime revocation. Refusal is admissible as evidence. Officers must advise drivers of the right to an independent test at their own expense.
