Arkansas DWI Laws and Penalties

Arkansas uses the term DWI (Driving While Intoxicated) for adults over 21 with a BAC of 0.08% or higher. The term DUI applies to drivers under 21 with a BAC between 0.02% and 0.08%.

Penalties increase with each offense. A first DWI brings up to one year in jail, a fine of $150 to $1,000, and a 6-month license suspension.
