DWI Law in Lincoln County
Arkansas DWI law (ACA § 5-65-103) applies throughout Lincoln County. The legal BAC limit is 0.08% for adult drivers. A first DWI offense brings up to one year in jail, a fine of $150 to $1,000, and a six-month license suspension. Arkansas does not allow plea bargaining on DWI charges. There is no option to reduce a DWI to a lesser offense through negotiation.
Repeat DWI offenses carry much heavier penalties under the 10-year lookback period. Second offense within 10 years: minimum 7 days in jail, up to $3,000 fine, 24-month license suspension. Third offense: 90 days to one year jail, up to $5,000 fine, 30-month suspension. Fourth or more within 10 years: felony, one to six years in state prison, four-year revocation. Repeat offenders must install an ignition interlock device before regaining driving privileges.
Underage DUI (ACA § 5-65-303) applies to drivers under 21 with a BAC of 0.02% or more. Even a small amount of alcohol creates a legal issue for a driver under 21. First offense: $100 to $500 fine, 90-day suspension, community service, mandatory alcohol education. No plea deals allowed. Second offense: $200 to $1,000 fine, one-year suspension, 30 days minimum community service. Third: $500 to $2,000 fine, revocation for three years or until age 21.
Implied consent law (ACA § 5-65-202) applies throughout Arkansas. All drivers consent to BAC testing when pulled over. First test refusal: 180-day suspension. Second within five years: two-year suspension. Third: three-year revocation. Fourth: lifetime revocation. The refusal can be used against the driver at trial. Officers must advise the driver of the right to arrange an independent test.
