Repeat offenders must install an ignition interlock device before license reinstatement.
Underage DUI (ACA § 5-65-303) applies to drivers under 21 with a BAC of 0.02% or more. First offense: $100 to $500 fine, 90-day suspension, community service, alcohol education. No plea bargaining for underage DUI. Second offense: $200 to $1,000 fine, one-year suspension. Third: $500 to $2,000 fine, revocation for three years or until age 21. No probation or plea deals allowed for underage DUI.
Arkansas implied consent (ACA § 5-65-202) requires drivers to submit to BAC testing when lawfully stopped. First refusal: 180-day suspension. Second refusal within five years: two-year suspension. Third: three-year revocation. Fourth: lifetime revocation. Refusal is admissible in court as consciousness of guilt evidence. The arresting officer must advise the driver of the right to an independent test at the driver's own expense.
