One important note about Izard County records: most records that predate 1889 were destroyed in a courthouse fire. The County Clerk holds marriage records from 1889 forward. DWI Law in Izard County
Arkansas DWI law (ACA § 5-65-103) applies throughout Izard County. The legal BAC limit for adult drivers is 0.08%. An officer can also charge DWI without a BAC reading if they observe enough signs of impairment. First-offense DWI carries up to one year in jail, a fine between $150 and $1,000, and a six-month driver's license suspension. There is no ability to plea bargain a DWI charge down to something lesser under Arkansas law.
Repeat offenses bring heavier penalties. A second DWI within 10 years means a minimum of 7 days in jail and up to a year, fines up to $3,000, and a 24-month suspension. Third offense: 90 days to one year in jail, fines to $5,000, 30-month suspension. Fourth or later offense within 10 years is a felony charge with state prison time possible. The 10-year lookback period was set in 2021.
Underage DUI (ACA § 5-65-303) applies to drivers under 21. The threshold is a BAC of just 0.02%. That is low enough that even one drink can lead to a charge. First-offense underage DUI brings a fine of $100 to $500, a 90-day license suspension, community service, and required alcohol education. No plea bargaining allowed for underage DUI either.
Under implied consent law (ACA § 5-65-202), all drivers in Arkansas are deemed to consent to BAC testing when pulled over. Refusing the test leads to its own separate license suspension. The refusal is also admissible in court. First refusal suspends the license for 180 days. A second refusal within five years means a two-year suspension.
